Remote Tuning Liability Waiver & Assumption of Risk

1. Nature of Services

I understand and acknowledge that remote tuning services consist solely of electronic calibration adjustments based on data logs, vehicle information, and feedback that I provide. I acknowledge that CAMTuning Performance, LLC does not physically inspect, diagnose, test drive, or verify the mechanical condition of my vehicle, and that all tuning decisions are made without direct access to the vehicle.

I understand that remote tuning is inherently limited by the quality, accuracy, and completeness of the information I submit.

2. Vehicle Condition & Owner Responsibility

Mechanical Soundness Certification:
I certify that my vehicle is mechanically sound and suitable for performance tuning, including but not limited to:

• No known engine, transmission, drivetrain, or electrical issues

• No fluid leaks

• Proper fuel quality

• Properly functioning sensors

• Completion of all required maintenance (spark plugs, coils, injectors, fuel system, cooling system, etc.)

I understand that failure to disclose known or unknown mechanical issues may result in engine damage, and that such damage is not the responsibility of CAMTuning Performance, LLC.

Pre-Existing & Resulting Failures:
I acknowledge that performance tuning may reveal or accelerate pre-existing mechanical weaknesses. I agree that [Your Business Name] is not responsible or liable for any mechanical, electrical, electronic, or structural failures, including but not limited to:

• Engine failure

• Transmission or torque converter failure

• Drivetrain or differential damage

• Fuel system failure

• Sensor or ECU failure

whether such failures occur during the tuning process or at any time thereafter.

3. Assumption of Risk

I understand that modifying vehicle calibration beyond factory specifications inherently increases stress on vehicle components and carries risk of damage, reduced component lifespan, and potential vehicle downtime.

I voluntarily and knowingly assume all risks associated with:

• Performance tuning

• Increased power output

• Altered shift behavior

• Modified torque management

• Any related mechanical or electronic consequences

I agree that I am proceeding entirely at my own risk.

4. Data Accuracy & Compliance

I acknowledge that tuning safety is dependent entirely on the accuracy of the data logs I provide. I agree to:

• Follow all logging instructions exactly as provided

• Use approved logging parameters only

• Stop driving immediately and notify CAMTuning Performance, LLC  if I observe knocking, warning lights, abnormal noises, hesitations, or drivability issues

I understand that failure to comply with logging instructions or to report issues promptly voids any responsibility on the part of CAMTuning Performance, LLC .

5. No Guarantee of Results

I understand that no specific power gains, drivability improvements, or outcomes are guaranteed, and that results vary based on vehicle condition, hardware configuration, fuel quality, environment, and driver behavior.

6. No Refunds / Final Sale

I acknowledge that remote tuning services are custom digital services requiring time, expertise, and calibration effort.
All sales are final.
No refunds will be issued once a base map, calibration file, or revision has been delivered, regardless of outcome, satisfaction, or decision to discontinue tuning.

7. Release of Liability & Indemnification

I hereby release, waive, discharge, and hold harmless CAMTuning Performance, LLC , its owners, employees, contractors, and affiliates from any and all claims, damages, losses, or liabilities arising from or related to:

• The tuning services provided

• Use or misuse of calibration files

• Vehicle operation before, during, or after tuning

I agree to indemnify and defend CAMTuning Performance, LLC  against any claims brought by third parties related to my vehicle or its operation.
